Company: Sustainably Fit LLC (“Sustainably Fit,” “we,” “us,” “our”)

Participant/Member: You (“you,” “your”)

This Agreement governs your access to and use of Sustainably Fit’s digital products, memberships, educational content, training programs, and community spaces (collectively, the “Services”). By checking the box at checkout and/or accessing the Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement in its entirety.


Part I — Health, Safety & Assumption of Risk

1) What You’re Joining

Sustainably Fit provides general fitness education, training programs, and related resources delivered digitally (including through third-party platforms such as Kajabi, Everfit, and Cronometer). Participation is self-directed and may occur without live, in-person supervision.

2) Not Medical Advice

You understand and agree that:

  • Sustainably Fit does not provide medical advice, diagnosis, treatment, rehabilitation, or emergency services.
  • All content is for general fitness and educational purposes and is not a substitute for individualized medical evaluation.
  • If you have health concerns, you will consult a qualified healthcare professional.

3) Your Responsibility to Determine Readiness

By purchasing, accessing, or participating in Sustainably Fit programs, you represent and agree that:

  • You are 18 years of age or older and legally able to enter into this agreement.
  • You are responsible for determining whether exercise is appropriate for you and for selecting appropriate exercises, loads, intensity, and substitutions.
  • You will start conservatively, progress gradually, and stop activity if something feels wrong.

4) When You Must Get Medical Clearance Before Beginning

Sustainably Fit is intended for apparently healthy adults. You agree that you will not begin training until you have medical clearance if any of the following apply to you (including if you suspect they apply):

Cardiac, circulatory, or respiratory red flags:

  • Chest pain or pressure with activity or at rest
  • Unexplained shortness of breath at mild exertion or at rest
  • Dizziness, fainting, unexplained loss of consciousness, or severe lightheadedness
  • Known heart condition, history of stroke, uncontrolled high blood pressure, or abnormal heart rhythm

Metabolic or systemic conditions requiring oversight:

  • Diabetes (Type 1 or Type 2) where exercise may require medication or meal adjustments
  • Kidney disease, uncontrolled thyroid disease, or any condition where exertion may be medically contraindicated

Orthopedic or neurological limitations:

  • Current injury that limits exercise, significant joint instability, recent fracture, or uncontrolled pain
  • Neurological conditions affecting balance, coordination, or safe movement

Pregnancy or postpartum:

  • Pregnancy or postpartum status where your provider has recommended restrictions, or you are unsure what is appropriate

Medications:

  • Medications that may significantly affect exercise tolerance, heart rate, blood pressure, blood sugar, balance, or alertness

If any of the above apply, you may still join Sustainably Fit, but you agree you will wait to begin training until you have provider clearance and will follow any restrictions provided.

5) Safety Rules You Agree to Follow

Exercise tips, substitutions, and caution notes in the program are supplemental guidance and are not a complete list of risks or modifications. You remain responsible for choosing options that fit your body, history, and equipment.

You agree that you will:

  • Train in a safe environment with adequate space, stable equipment, and appropriate footwear
  • Use safe technique, controlled range of motion, and conservative loading, especially when learning new movements
  • Use alternatives or substitutions when needed
  • Avoid extremes or max-effort attempts if you are unsure of your technique or tolerance
  • Stop immediately if you experience chest pain, dizziness, faintness, severe shortness of breath, severe headache, or any unusual symptoms

6) Emergency Disclaimer

Sustainably Fit cannot respond to emergencies during self-directed training. If you believe you are experiencing a medical emergency, call emergency services immediately.

7) Assumption of Risk

You understand that physical activity involves inherent risks, including but not limited to muscle strains, tendon/ligament injuries, sprains, falls, aggravation of pre-existing conditions, equipment failure, and environmental hazards. You knowingly and voluntarily assume all risks arising from your participation, including risks resulting from your own actions or failure to follow safety guidance.

8) Release of Liability

To the fullest extent permitted by law, you release and discharge Sustainably Fit LLC, its owners, employees, contractors, and representatives from any and all claims or causes of action arising out of your participation. This includes claims alleging ordinary negligence by Sustainably Fit. Claims covered by this release may include, for example, claims for personal injury, illness, disability, death, or property damage, except where prohibited by law.

9) Indemnification

You agree to indemnify and hold harmless Sustainably Fit LLC from claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from your breach of this agreement, misuse of the program, or negligent or wrongful conduct.


Part II — Terms of Use & Membership

10) Scope of Services

Sustainably Fit provides general fitness education and self-directed training resources. We do not provide medical, diagnostic, therapeutic, or emergency services. Your participation is voluntary and at your own risk.

11) Payments, Trials & Cancellation

  • Membership terms, billing frequency, and pricing are described at checkout.
  • Trials, if offered, are available to new members only and may be used once per person, regardless of the email address used to register. Attempting to claim a second free trial by registering under a different email address or account is a violation of these Terms. Sustainably Fit reserves the right to revoke access to any account found to be in violation of this policy without prior notice or refund. If you believe your trial eligibility has been incorrectly determined, please contact us at [email protected].
  • Trials convert automatically to a paid subscription unless you cancel before the trial ends.
  • You may cancel according to the instructions in your account settings. Cancellation stops future billing; access continues until the end of the current billing period or trial unless otherwise stated at checkout.
  • Founding Member rate: If you are offered a Founding Member rate, it is locked while your membership remains active. If you cancel, the locked rate may be forfeited and you may be required to rejoin at the current standard rate.

12) Founding Season & Platform Delivery

Sustainably Fit is currently in its Founding Season — an early period in which the platform is live and fully functional, but continuing to grow and evolve. Content, features, and integrations may be added, refined, or restructured over time as the platform matures.

Parts of the experience are delivered through third-party platforms (such as Everfit for training and Cronometer for nutrition tracking). Sustainably Fit is not responsible for outages, errors, or policy changes of third-party services, though we will make reasonable efforts to maintain a smooth member experience.

13) Program Changes & Platform Updates

We may update, replace, or remove content, programs, features, or platforms to improve quality, performance, or safety. We may add or discontinue integrations with third-party platforms.

14) No Guarantee of Results

Results vary. Your outcomes depend on effort, consistency, personal factors, and adherence. We do not guarantee specific results.

15) Intellectual Property

All content provided through Sustainably Fit (programs, workouts, videos, PDFs, guides, templates, lessons, branding, and materials) is owned by Sustainably Fit LLC or licensed to us and is protected by intellectual property laws.

You agree you will not copy, reproduce, republish, distribute, upload, share externally, resell, sublicense, or create derivative products from our content, and you will not share your login or grant access to non-members.

16) Disclaimers & Limitation of Liability

To the fullest extent permitted by law, the Services are provided “as is” and “as available.” We are not liable for injuries, losses, or damages arising from participation, misuse of content, or reliance on information provided. We are not responsible for third-party platform failures, outages, or policy changes.


Part III — Community Conduct

17) Community Standards

If you participate in community spaces (Kajabi community, Everfit community, group chats, or similar), you agree to:

  • Be respectful and professional
  • Avoid harassment, bullying, discrimination, hate speech, or threats
  • Avoid sexually explicit content or graphic/offensive material
  • Avoid spam, solicitation, or promotion unrelated to Sustainably Fit
  • Respect member privacy (no sharing screenshots or content outside the community without permission)

We may remove content, restrict posting, or terminate access for violations.

18) Acceptable Use & Account Security

You agree not to interfere with platform functionality, attempt to access restricted areas, violate laws or others’ rights, impersonate others, or misrepresent your identity. You are responsible for maintaining the security of your login credentials.

19) Termination of Access

We may suspend or terminate access if you violate this Agreement, misuse content, engage in unsafe or abusive behavior, or fail to pay applicable fees.


Part IV — Media Consent

20) Use of Member Content

Sustainably Fit does not use your testimonials, progress photos, screenshots, messages, or other member-provided content for marketing, promotional, or public-facing purposes without your explicit written consent.

If we would like to feature your content in any capacity, we will reach out to you directly and request written permission before doing so. You are under no obligation to agree, and declining will have no effect on your membership, access, or experience.


Part V — General Provisions

21) Governing Law & Venue

This Agreement is governed by the laws of the State of Colorado, without regard to conflict of law principles. Any dispute arising out of or relating to this Agreement will be brought in the state courts located in Larimer County, Colorado, or, if applicable, the United States District Court for the District of Colorado, and you consent to the personal jurisdiction of such courts, unless otherwise required by law.

22) Severability

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

23) Entire Agreement

This Agreement represents the entire agreement between you and Sustainably Fit regarding your participation in the Services and supersedes any prior or contemporaneous communications on the same subject.

24) Acceptance

By checking the box at checkout and/or accessing the Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement in its entirety. This includes the health and safety acknowledgment, assumption of risk, release of liability, terms of use, community conduct standards, and media consent provisions contained herein.
